POTTER FAMILY WILLS


DAVID POTTER
1808 - 1865

In the name of God, amen, I David Potter of the town Berlin in the county of Rensselaer and state of New York (being of sound mind and memory blessed be God for the same) do make this and publish this my last will and testament.

After all my just debts and funeral expenses are paid I give and bequeath to my sons Daniel E. and David J. Potter all my property both real and personal except my household furniture which they are to keep together until David J. shall become twenty one years of age, then one may sell out to the other if they so choose but not to sell or dispose of my portion of the farm to any body else.  Within five years after my death or decease I order or decree that they (my said) sons shall pay to my daughters Susan M. Brimmer & Olive L. Babcock the sum of fifteen hundred and thirty three dollars each, and to my daughters, Sarah M. and Ann A. Potter the sum of twelve hundred Dollars each and they shall pay my administrators the sum  of Fifteen hundred and thirty three dollars for the sole use and benefit of my daughter Charlotte C. Green and her children to be by them the (administrators) kept and used for her benefit as necessities may require.

And I further order that my said sons shall at any time my beloved wife Lois shall see fit to leave the premises and remove some where else pay her one thousand dollars in lieu of dower.  I also bequeath to my wife Lois my entire household furniture during her lifetime, after her death to be divided equally between my children then living.

I do nominate and appoint Hiram Babcock and Daniel E. Potter to be administrators of the my last will and testament.

In testimony whereof I hereunto set my hand seal and publish and decree this to be my last Will and testament in presence of the witnesses named below, this fourteenth day of March in the year of Our Lord one thousand eight hundred and sixty five.

Signed Sealed decreed and published by the said David Potter as and for his last will and Testament in presence of us who at his request and in his presence and in presence of each other have subscribed our names as witnesses hereto
