Surrender of Plomer Green by Descendents of Thomas Oxlade (1641-1706) to Sir Francis Dashwood

At the court of the manor of West Wycombe, copy of surrender of land:

"Whereas James Oxley late of the parish of Saint George Hanover Square did in and by his last Will and Testament in Writing bearing Date the Fifth Day of September ...1731 Give and bequeath unto his Wife Sarah Oxley all his Estate lying and being in the Parish of West Wycombe in the county of Bucks known by the name of Plomer Green containing Pastural Meadow and Arable Lands together with all Dwelling Houses and all other outhouses stables and barns and all other appurtenances thereunto belonging by her to be freely possessed and enjoyed so long as she shall continue unmarried and a Widow and constituted and appointed his said Wife to be executrix of his said Will and also bequeathed unto his Child or Children wherewith his said Wife was then pregnant one hundred pounds to each out of his said estate to be paid by his executors when sale could or should be made of the said Estate and gave and bequeathed unto his son William Oxley the sum of Thirty Pounds out of his estate to be paid to him by his executrix so soon as it should be in her power to make sale of the said estate and also constituted and ordained his said son William Oxley his sole executor of this his last Will and Testament if his said Wife should dye or be Married before the Infant or Infants before-mentioned should come to Age. And in Case his said Wife Sarah and her Child or Children should dye then the said estate should be disposed of and equally divided amongst his five sons James, Daniel, John, Thomas and William Oxley or to the survivors or survivor of them and his son William to have his legacy of Thirty Pounds before the division to be made and afterwards to have his share equal with his other brothers each to have a share and share alike

And Whereas the said James Oxley dyed before the birth of the Child his said Wife Sarah was enceinte with at the time of making his said Will without altering or revoking the same who is now of age. And Whereas the said Sarah Oxley is since Dead. And Whereas the said James and David Oxley two of the sons of the said James Oxley the Testator are also dead. And Whereas at a special Court Baron held in and for the Manor aforesaid on Friday the twentyfifth day of July last the said William Oxley was admitted Tenant to all and singular the said Pastural Meadow and Arable Land mentioned in the said recited Will of the said James Oxley by the names and descriptions of All that messuage and half yard land with the appurtenances lying and being at Plomer Green in the Parish of West Wycombe and Manor aforesaid and of all that Meadow with appurtenances situate and lying and being at Mill End in the parish of West Wycombe and Manor aforesaid And also to all houses outhouses edifices buildings barns stables yards orchards gardens ways waters easements and appurtenances thereto belonging or appertaining to and for such uses Ends Intents Trusts and Purposes as in and by the said recited Will are meant mentioned directed limited and appointed. And Whereas afterwards at a special Court Baron held in and for the said Manor on Tuesday the Twenty Sixth day of

August last the Homage then presented that Thomas Oxley was the Grandson and Heir at Law of the said James Oxley the Testator and of full age. Whereupon the said Thomas Oxley in his own proper person came into Court and humbly prayed that he might be admitted Tenant to the said hereinbefore mentioned Premises with their appurtenances by the names and Descriptions aforesaid. To whom the Lord of the Manor aforesaid by his Steward granted and delivered Seisin thereof by the Rod. To have and to hold by Pledges the Premises aforesaid with the appurtenances to the said Thomas Oxley his Heirs and Assigns for ever. Subject nevertheless to such Devises Uses Trusts Ends Intents and Purposes as are mentioned and declared of and concerning the same in and by the said recited Will of the said James Oxley his grandfather deceased. And Whereas the said John, Thomas and William Oxley the three surviving sons of the said James Oxley the Testator have contracted and agreed with Sir Francis Dashwood of West Wycombe aforesaid Baronet, Lord of the said Manor for the absolute Purchase of all and singular the said Premises hereinbefore mentioned in Consideration of the sum of Four Hundred and forty pounds of good and lawfull money of Great Britain to be paid to the said John, Thomas and William Oxley in the shares and proportions mentioned and directed in and by the said recited Will of the said James Oxley the Testator.

Be it remembered that on the Day of the year above written the said William Oxley by John Weale of the Parish of

Saint James's Clerkenwell in the County of Middlesex, writing master his attorney at law fully authorised and Thomas Oxley the Grandson by and with the Consent and Direction of the said John Oxley and Thomas Oxley the other two surviving sons of the said James Oxley the Testator did out of Court by the Rod according to the Custom of the Manor aforesaid by the hands and acceptance of Edward Glen the Gentleman Steward of the said Manor; Surrender into the hands of the Lord of the said Manor all that said Messuage and half yard land with the appurtenances lying and being at Plomer Green aforesaid and all that Meadow with the appurtenances situate lying and being at Mill End in the parish of West Wycombe and Manor aforesaid hereinbefore mentioned and all houses outhouses edifices buildings hams stables yards... And also all the estate right title interest property claim and Demand whatsoever of them the said William Oxley and Thomas Oxley or either of them or either of their Heirs Executors Administrators or assigns of in and to the said Premises or to any part or parcel thereof to the use and behoof of the said Sir Francis Dashwood Baronet Lord of the said Manor and of his heirs and assigns for ever according to the custom of the said manor. And the said John Oxley and Thomas Oxley the sons of the said James Oxley the Testator Deceased each of them doth hereby for the consideration aforesaid demise release and for ever quit claim unto the said Sir Francis Dashwood his heirs and assigns all the estate right title Interest benefit Trust claim and demand whatsoever which they the said John Oxley and Thomas Oxley their executors or administrators can shall or may have or claim of in or to the said premises or of in or to any sum or sums of Money by value of and under the said recited will of the said James Oxley their late Father deceased. And the said John Weale Both hereby for himself his executors and administrators covenant promise and agree to and with the said Sir Francis Dashwood his heirs executors and administrators that he the said John Weale or the said William Oxley or either of them have not nor hath heretofore done committed or willingly suffered any act matter or thing whatsoever whereby or by means whereof the premises hereinbefore surrendered or any part thereof are, shall or may be charged or incumbered in title charge estate or otherwise howsoever. And the said Thomas Oxley the grandson of the said James Oxley doth hereby covenant promise and agree for himself his heirs executors and administrators that he hath not done or committed or willingly suffered any act matter or thing whatsoever whereby or by means whereof the said Premises or any part thereof are shall or may be charged or incumbered in title charge estate or otherwise howsoever.

said Premises or to any part or parcel thereof to the use and behoof of the said Sir Francis Dashwood Baronet Lord of

the said Manor and of his heirs and assigns for ever according to the custom of the said manor. And the said John

Oxley and Thomas Oxley the sons of the said James Oxley the Testator Deceased each of them doth hereby for the

consideration aforesaid demise release and for ever quit claim unto the said-Sir Francis Dashwood his heirs and

assigns all the estate right title Interest benefit Trust claim and demand whatsoever which they the said John Oxley and
