596, 597, 598. JAMES PRICE, JOHN WILSON, and WILLIAM DAY were indicted for stealing a printed book intitled, The Fruit Shop, a Tale, or a Companion to St. James's-street, vol. I. the second edition, value eighteen pence, and four other printed books, value three shillings, the property of William Oxlade, June 27th.

WILLIAM OXLADE sworn.

I am a bookseller: I lost a book intitled, The Fruit Shop, and four other books, out of my shop on the 26th of June; I missed them the next day; before the justice, Price said he knew nothing of my books; I found them at Burn's. [The books were produced in court, and deposed to by the prosecutor.]

THOMAS BURN sworn.

I am a bookseller: I bought the books of Wilson and Day; Wilson made the bargain; Day took the money. 'The prisoners Wilson and Day said in their 'defence they never saw the money.'

PRICE NOT GUILTY.

WILSON and DAY GUILTY of stealing the books to the value of ten pence. W.

594, 595. JAMES PRICE and WILLIAM DAY were indicted for stealing a printed book intitled, The Modern Gazetteer, or A short View of the several Nations of the World, &c. value two shillings and six pence, the property of James Lockington, July 1st.

JAMES LOCKINGTON sworn.

I am a bookseller: I lost The Modern Gazetteer out of my window on the first of July, it was produced before the justice; I have had it ever since; it is my book (producing it).

WILLIAM OXLADE sworn.

I took the prisoners before the justice on another charge, and Price confessed selling this book to Burn.

THOMAS BURN sworn.

I bought this book of the prisoners; Oxlade came and challenged it; then Price said he stole it in Chiswell-street.

'The prisoners in their defence said they'found the book in Old-street.'

BOTH GUILTY of stealing to the value of ten pence. W.

714. JOHN MORTON otherwise WHARTON was indicted for stealing a printed book, intitled Syphillis, a practical dissertation on the venereal disease, &c. value 18 d. and four other printed books, value 2 s. the property of William Oxlade, September 2d.

WILLIAM OXLADE sworn.

I keep a book stall in Holborn; this book Syphillis was on a stall, which I kept a little girl of eight years old to look after; I was up stairs for about ten minutes, when I came down I missed it.

GEORGE MILES sworn.

On the second of September I bought this book of the prisoner.

[The book was produced in Court, and deposed to by the prosecutor.]

PRISONER's DEFENCE.

I bought the book among some cloaths of an old cloaths man.

GUILTY.
