Subject Of Transaction: Recites Lease and Release of 25/26 June 1787, by way of marriage settlement for William Birkhead of Watlington, surgeon, and Elizabeth Mary Harness of Watlington, spinster, daughter of Wm. Harness of Watlington, apothecary, whereby the following premises were conveyed to Wm.Lowndes and Andrew Price on several trusts

Messuage with 2 orchards and appurts.

Arable called the Piddle adjoining the messuage

Several closes of arable and woodground commonly called The Four Acres the Sixteen Acres, The Hither Seven Acres, The Six Acres, the Further Seven Acres containing 7a., the Hoggtrough Close or Hogg Trough Field (12a.)

Close of arable containing 3a.adjoining to the Copy Lane (coppie or coppice ?)****** on the north, the land then or late of Mr.Abingdon esq. on the east, the lands then or late of John Langley*** on the south and the woods of John Langley on the west.

All the above premises were then late held by John Langley***, then Jonathan Oxlade, ***then Thomas Oxlade ****and were at or near the copy (coppie or coppice ?)******* in Great Marlow, Bucks and contained altogether 61a.

Messuage with appurts. in Britwell alias Brightwell Sollom alias Salome, formerly held by Matthew Mattingley, then by Thomas Hussey, with the highway leading from Brightwell Sollom to Brightwell Grove on the north, and the highway from Brightwell Sollum to Henley on the east. Close of pasture with appurts. near the messuage, with the Brightwell Sollum - Henley road on the east, Davis Close pasture on the west and a common field called Stibb Field on the south.

12a.1r. arable in the common fields of Brightwell Sollum and Brightwell Pryor with appurts.

All the above lands are in Brightwell Sollum and Brightwell Pryor and were formerly held by Matthew Mattingley and then by Thomas Hussey. Messuage lately built by William Harness on ground where a messuage formerly held by William Jilkes formerly stood with appurts. in Watlington, at the upper end of Couchin Lane, between the messuage of John Sadler on the north-east side and the messuage of Elizabeth North on the south-west side.


Recites that in 1799, William Harness redeemed the annual land tax of £5-12s. due from the messuage, outbuildings and 110a. land at Britwell Salome, in the occupation of Aylmor Jones and the annual land tax of 18s.9d. due from the messuage and garden with appurts. at Watlington held by William Harness, and the annual land tax of £5-4s due from farm with appurts. in Gt.Marlow, held by Thomas Oxlade, as appears by 2 certificates dated 26 January and 29 April 1799.


Recites will of William Harness dated 12 March 1791 whereby he devised all his residuary personal estate to his wife, Elizabeth Harness


Recites that Elizabeth Harness died intestate in the life of her husband who then published a codicil to his will dated 2 February 1811 whereby amongst other bequests, he devised his residuary personal estate to his daughter, Elizabeth Mary Birkhead


Recites that he died on 11 April 1815 and the will and codicil were proved with 2 other codicils, 25 May 1815.


Recites that there were 8 children of the marriage of Wm.Birkhead and Elizabeth Mary, his wife, namely: 1b.,


Mary Elizabeth who died in 1794 and infant, 2b., who died in 1803 an infant and without having been married (sic), 3., 4b., George who died in 1805 an infant without having been married, and Richard.


These children were tenants in common intail of the premises comprised in the aforesaid marriage settlement, expectant on several estates thereby created.


Recites Release of 10 January 1818 whereby, after reciting that Elizabeth Mary Birkhead, as one of the 5 children of William Birkhead was seised, under the recited settlement, of 1/5th part of the premises, expectant upon the decease of the survivor of the parents, it was witnessed that in consideration of her intended marriage to 1a., her share in: messuage and premises in Britwell Salome formerly held by Thomas Hussey and John Hussey, then by John Spyer and then by James Lovelock; and in ******messuage and premises in Grt.Marlow, then late held by Thomas Oxlade and *****the by... Brooks; and in messuage and appurts. at Watlington, then held by William Birkhead, were conveyed to William Lowndes Stone and William Scoles upon several trusts.


Recites Release of 18 January 1822 whereby after reciting that 2b. was likewise entitled to 1/5th share in premises as above, expectant upon decease of the survivor of her parents, it was witnessed that in consideration of her intended marriage to 2a., her share in premises were conveyed to Thomas Clist and 4b. upon several trusts.


Recites that the lands in Brightwell Salome and Brightwell Pryor have now been intermixed since the enclosure of those places.


Recites Lease of 22 October 1824 whereby 4b. in consideration of £850 paid to him by William Cozens of Watlington, banker, he demised his share in: premises at Brightwell Pryor and Brightwell Sollum then held by Edmund Painter; Premises in Gt.Marlow, then held by,.. Brooks; Premises in Couchin Lane, Watlington, then held by William Birkhead, for 500 yrs. by way of mortgage.


Recites Bargain and Sale of 1 November 1827, enrolled in Chancery on 19 September 1829, whereby after reciting that 4b. had been declared bankrupt and that 2a. and William Hamp had been chosen assignees, 4b.'s share in premises as above was assigned to them, in trust for the creditors of 4b.


Recites that William Birkhead died in June 1829


Recites enclosure award for Brightwell Salome and Britwell Prior dated 21 June 1845 whereby the following premises were awarded to Elizabeth Birkhead, widow of William Birkhead, as tenant for life:

Allotment of land in Britwell Salome no.51 containing 91a.20p. bounded by the Henley Road, by the Icknield Way, by the parish of Swyncombe, by the parish of Ewelme, by the second allotment to her, and by the Swyncombe and Goulds Heath Road

Allotment of land in Britwell Prior no.148 containing 3a.3r.4p., bounded by the first described allotment, by the parish of Ewelme and by the Swyncombe and Goulds Heath Road.

Allotment of land in Hare-patch, par. of Britwell Salome, no. 47, containing 3a.1r.23p., bounded by the 14th allotment to Richard Newton, later awarded in exchange to Elizabeth Mary Birkhead, by allotment to the devisee of William Goodwin, by the parish of Swyncombe and by the Icknield Way. And to Richard Newton in lieu of his freehold commonable lands and rights of common purchased by him from John Stopes, the allotments described in the award and consisting of allotment in Hare-patch, no.48 containing 8a.2r.24p., bounded by the Henley road, the fifth allotment to the devisee of William Goodwin, the third allotment to Elizabeth Mary Birkhead and the Icknield Way. This allotment was awarded to Elizabeth Mary Birkhead in exchange for Yardleys Close.


To Richard Newton, in exchange for his fourteenth allotment later awarded to Mary Birkhead, freehold close in Britwell Prior, no.163, called Yardleys close, containing 3a.3r.3p. adjoining the Wallingford-Watlington road, on the north west and the twelfth allotment to Richard Newton on the south east.


To Elizabeth Mary Birkhead, in lieu of the close awarded in exchange to Richard Newton: freehold allotment in Hare Patch, Britwell Salome, no. 48 containing 8a.2r.24p.


Recites that Elizabeth Mary Birkhead died 20 February 1846 intestate leaving 4b. her eldest son and heir.

Administration of her estate was granted to 3. on 3 September 1849


Recites that in consequence of the deaths without issue of Mary Elizabeth Birkhead, George Birkhead, and William Birkhead, three of the aforesaid children, the premises were on the death of Elizabeth Mary Birkhead divisible into 5.


Now, in order to disentail the premises, and in consideration of 10s. paid to 1.,2.,3.,4b. and 5. by 6., they convey to 6. and his heirs: premises in Great Marlow, Bucks, Britwell Salome, Britwell Prior and Watlington, subject to charges of £ £239-14-2d and £154- of £3% consold so transferred by William Harness for the redemption of the land tax. 6. to hold premises on trust for the five several persons entitled to their premises and their heirs.
