John McWhorter sells Virginia land to Alexander Patton
February 11, 1752

This Indenture made the Eleventh Day of February in the year of our lord Christ one thousand Seven hundred & fifty two & in the Seventy Sixth year of the Reign of our Sovereign Lord George the Second by the Grace of God King of Great Britain between John McWhorter of the Parish of St Anne in the county of Albemarle & Collony of Virginia of the one part & Alexander Patton of the Parish & County & Colony aforesaid of the other part & witnesseth that the said John McWhorter for & in consideration of the sum of ninty pound Current money of Virginia to him in hand paid or secured to be paid before the sealing & delivering of these presents the receipt whereof the said John McWhorter doth hereby confess & acknowledge to be therewith fully satisfied & paid Hath granted bargained, sold, aliend, enfeoffed, & confirmed & by these presents Doth Grant, Bargain, Sell Alien Enfeoff & Confirm unto the said Alexander Patton his heirs & assigns forever one Certain tract & parcel of Land Containing one hundred Sevinty Acres be the same more or less.

Convied to him by James MíCanne by the bearing Date the Tenth Day of September in the year of our Lord Christ one thousand seven hundred & forty seven & Granted to Said James MíCanne by Patent & bearing Date at Williamsburg the Tenth Day of July one thousand seven hundred & forty five (Excepting one acre & thirty five poles sold & convied by Deed by the aforesaid James McCanne to John Reid, James Robertson & Samuel Bell their heirs & assigns forever under the Special trust by the Presbyterian Inhabitants of the Settlement of Rockfish to appropriate the said acre & thirty five poles of Land for to build a meeting house upon for the publick Worship of God & School house & burying ground to themrockfish church historical sign (Viz & the aforesaid Presbyterian Inhabitants) lying & being in the County of Albemarle on the Branches of Rockfish River & is bounded as followeth (to wit)

Beginning at a maple on the South Side of Rockfish River West Branch running thence on Edward Maloy South Seventy Seven Degrees West Seventy four poles crossing the said Branch to Pointer thence on [Wm?] Hickmanís North thirty degrees west one hundred & [twenty?] five to a Blackoak thence on James Hendrickís North sixty degrees East two hundred & twenty five poles to Pointers Thence on Jonah Clappam South two hundred poles to rockfish River West Branch thence up the same according to its meanders one hundred & twenty two Poles to the first Station with all woods swamps meadows houses Orchards & all other profits & commodities to the same belonging & all the estate right title Interest Claim & Demand whatsoever of him the said John McWhorter of in & to the said Land & premises & every part & part & parcel thereof John McWhorter's rockfish river propertyTo have & to hold the said Land & all other the before Granted Premises with their appurtenances unto the said Alexander Patton his heirs & assigns forever to the only proper use and behoof of him the said Alexander Patton his heirs & assigns forever & the said John McWhorter for himself & his Heirs the said Land & premises against him & his heirs and all persons Claiming from by or under him them or any of them the said Alexander Patton shall & will warrant & forever Defend and Lastly that the said John McWhorter his heirs Shall & will at any time hereafter within the space of Twenty Years ( ) after the Date of these presents make do & Execute at the Expence of Alexander Patton or his heirs or assigns Such other and further convieance & Convieances as by the Alexander Patton or his Councel learned in the law shall be advised Devised or required.

Memorandum that on the Eleventh day of February...Livery and seisin of the within sold Land & premises was acknowledged made & Done by the within named John McWhorter to the Alexander Patton for him his heirs & assigns forever.

The (  ) of Alexander Patton the sum of ninety pounds current money of Virginia being the within intentioned Consideration.

This indenture memorandum of Livery of his in Receipt theron indorsed ( ) acknowledged by John McWhorter one of the Parties thereto & ordered to be recorded.
