SECTION 4 BEDFORD CO., PA.
JOHN LANE SR. AND JOHN LANE JR. of BEDFORD CO., PA.
Turning to the information regarding the Revolutionary Soldier of Broadtop or
Hopewell Townships in Bedford County, PA, whose name was also John Lane, I would
like to present information which will prove that he is NOT the correct father
of John Lane, Sr. of Washington Co., PA.
I would like to make it clear that John Lane of Bedford County, Pa. was
indisputably in the Revolutionary War, and his service and pension records are
well documented.
Statements of facts, based on research:
First, it is TRUE that John Lane (Sr.) Rev. Soldier had a son named John Lane,
(Jr.).
It is FALSE that the son, John Jr. <s/o the Rev Soldier of Bedford Co.,
Pa.> was married to Catherine Baker.
I would like to make it clear that the Revolutionary War John Lane INDEED had a
SON named John Lane and that John Jr. married Sarah Davis [read further for
proof on maiden name]. However, I have proof that this son was
LIVING in Bedford Co., PA through the time when my known ancestor (John Lane,
Sr. of Washington Co., PA, married to Catherine Baker) was living in Washington
Co., PA. and DIED there.
If you compare the list of children given on the DAR to the children named in
the WILL of JOHN LANE, Revolutionary Soldier of Bedford Co., PA, you will see
the same NINE "given" names listed (with variations of spellings of
the name Sera Lane and Meony Lane). (WILL of John Lane Bedford Co., PA) Book #3
p. 246, written Dec. 3, 1929 Probated Mar. 15, 1843). Enclosed is a copy
of the Bedford County Will of John Lane for your inspection.
THE WILL OF JOHN LANE "SR" OF BEDFORD CO., PA
REVOLUTIONARY SOLDIER (Transcript)
WILL of John Lane Bedford Co., PA, Book #3 p. 246, written Dec.
3, 1929 Probated Mar. 15, 1843
In the name of God, Amen. I John Lane of the township of
Hopewell County of Bedford in the state of Pennsylvania farmer being of sound
mind memory and understanding but considering the uncertainty of this transitory
life do make and publish this my last will and testament in manner and form
following to wit:
First it is my will and I do order that all my just debts and funeral expenses
be duly paid and satisfied as soon as conveniently can be after my decease.
I give and bequeath all my lands situate in Hopewell township TO MY SONS JOHN
and DAVID to be divided in manner following beginning at a __ __ a white oak at
a lane upon South East side of the four hundred acre tract to run a North West
course or marked line to be the division line that I marked myself to my son
JOHN the South West ends of the land as far as to join Henry Warsing lands which
I sold to said Warsing the South East and North ends to my son DAVID from the
marked line as before mentioned. I give and bequeath all other lands which I may
have at my decease and all personal property money and debts that may be due me
at my decease to my daughter DEBORAH my daughter SERA and my daughter REBECCA
and my daughter ELIZABETH and my daughter JULIANE to be equally divided between
them.
I give and bequeath to my daughter HANNAH one dollar to be paid out of my
personal property. I give and bequeath to THE HEIRS OF MY DAUGHTER MEONY one
dollar to be paid out of my personal property. I give and bequeath to THE HEIRS
OF MY DAUGHTER MARY one dollar to be paid out of my personal property. It is my
will that my sons JOHN and DAVID shall settle my estate as soon as possible at
their own expense and divide as before mentioned.
And lastly I nominate constitute and appoint my sons JOHN and DAVID to be the
executors of this my will hereby revoking all other wills legacies and bequests
by me heretofore made and declaring this and no other to be my last will and
testament.
In witness whereof I have hereunto set my hand and seal the third day of
December One thousand eight hundred and twenty nine.

Personally appeared before the subscriber Register for the Probate of wills and
granting letters of administration in and for said County William ALEXANDER Esq
One of the subscribing witnesses to the foregoing instrument of writing who
being duly sworn ___ ___ and say that sometime last fall perhaps in September he
was called on by JOHN LANE and requested to sign his name as a witness to said
instrument of writing or last will, that said testator declared in his presence
that the same was his last will and testament, that he had signed it as such and
was still satisfied therewiths -- de___ further says that at the time above
referred to said testator was of sound and dis____ mind memory and understanding
to the best of his knowledge and belief that the said deponet signed his name in
the presence of Henry WARSING whose name is also subscribed as a witness:
Sworn and Subscribed the 22nd day of February 1843

Bedford County ___ Also personally appeared before the said Register Henry
WARSING another subscribing witness to the foregoing Instrument of writing and
being duly sworn saith that some time last September he was called on by JOHN
LANE and requested to sign his name as a witness to said instrument of writing
or last will, that said testator declared in his presence that the same was his
last will and testament, that he had signed it as such and was still satisfied
therewiths -- de___ further says that at the time above referred to said
testator was of sound and dis____ mind memory and understanding to the best of
his knowledge and belief that the said deponet signed his name in the presence
of William ALEXANDER whose name is subscribed as a witness:
Sworn and Subscribed the 15th day of March 1843

Be it remembered that on the 15th day of March Anne Dominic 1843 Letters
Testamentary (?) were issued JOHN LANE and DAVID LANE Executors in the
foregoing will named, they having been first duly sworn according to law.

NOTES on the WILL of JOHN LANE of BEDFORD CO., PA.
1. Note that the Executors named are his two sons, John and David (the first two
names listed on the DAR as his children).
2. Additionally, you will notice that in 1843, John and David make an
"appearance" in the Bedford County Courthouse in reference to their
father's Will. Considering that my known ancestor (John Lane, Sr.) down/over
in Washington Co., PA. is deemed to be about 70 years old (in his Obituary) at
the time of his death in Dec. 1844, it seems highly unlikely in my logic that my
John Lane would have been traveling to Bedford Co., PA. to settle the estate of
his "supposed" father in 1843 (when my John Lane would have been about
70 years old).
Also, John Lane, Sr. (and family) of Washington Co., Pa. appear to have been, at
minimum, not very well-off financially. Although my John Lane had no Will, *IF*
he had just inherited lands from his "supposed" father in Bedford
County in 1843, this certainly would have appeared within the Account Record of
my John Lane, Sr. in Washington Co., PA (See File "L", #8, 1846,
administered by his son, Daniel Lane). An inheritance such as that would have
made an impact, certainly, in the Washington Co., PA Courthouse records through
the Estate Account, and in the Deeds office of both counties, or possibly even
in the Prothonotary's Office. All these prove negative, however, for any
connection to an inheritance from Bedford Co., PA . As well, this inheritance,
if connected to my ancestor in Washington Co., PA would have undoubtedly shown
up in Bedford County Courthouse records, especially considering that the
Washington County., PA John Lane dies so soon after the Bedford County
Revolutionary Soldier. Again, there is no indication through the Bedford Co., PA
Courthouse or the Washington Co., PA records that any familial father-son
connection existed between these 2 men of the same name.
Additionally, I am also enclosing a DEED from Bedford County, PA. made in 1849
by THE SON John Lane, (e.g. son of the Rev. Soldier). This CLEARLY states that
he is now selling land which had been bequeathed to him by his father, John, per
his will. Please refer to page 2 of this deed, which indicates the
relationship as well as the fact that it is part of the same land previously
owned by the Revolutionary Soldier. Our John Lane (Sr.) who is
"supposedly" the son of the Rev. Soldier is already dead
[died 1844], so he cannot be selling the land of the Bedford Co. John Lane
Sr.
DEED FROM JOHN LANE "JR" AND HIS WIFE SARAH to THOMAS PRICE
Deed Book "Y" p. 475 1850, dated 13 April 1849
**specifies that John Lane got this land by the Will of his father, John Lane,
Sr. dated 3rd Dec 1829
(Although working from 2 Xerox copies, the deed is still almost impossible to
read.)
This Indenture made the 13th day of April in the year of our
Lord 1849 between JOHN LANE and SARAH HIS WIFE of Broadtop Twp. in the County of
Bedford and State of Pennsylvania of the one part and Thomas Price of the same
County and State _____ of the other part. ______ that the said John Lane and
Sarah his wife _____ in consideration of the sum of $1, 000.00 lawful money ___
to them in hands paid by the said Thomas PRICE at and before the unsealing and
delivery hereof the receipt whereof they do hereby acknowledge these ....and
confirm unto the said Thomas Price his heirs and assigns all the following
described _____ ________ and being situate in Broadtop Township Bedford County
and state of Pennsylvania beginning at a stone South Eighty seven East sixty six
to a white oak, north seventy eight eat one hundred and seventy eight to a white
oak adjoining _____ _______ mountain North eleven West twelve to a pine north
Eight West seventy two to a white oak north eleven West nineteen ____
(unreadable on 2 xerox copies) (page 476) North seven West seven to a Red Oak,
North one West twenty six to a hickory _____ East fifteen and a half to a white
oak North six east twenty (to a) Chestnut oak North sixty to a black oak
adjoining DAVID LANE south seventy four West one hundred sixty eight to a Post,
South nine West ninety six to a white oak South twenty three to a sassafras
South Eleven West ninety eight to a Post, south eighty nine West nine to a Pine,
South seventy six West fourteen ____ fifty nine west fourteen to a White Oak
South eighty four West fifteen Soth seventeen West twenty three to stones the
place of beginning containing one hundred and forty one acres and allowance
being part of a survey in the _______ LANE by two warrants the one dated the
eleventh day of March 1794, the other dated the 28th day of March 1806.
Also two Patents bearing date the twenty ____ day of ___ 1829 and whereas the
said JOHN LANE did by his Last WILL and Testament bearing date the third day of
December 18_9 give and bequeath unto HIS SON JOHN LANE the before mentioned
______ . Together with all and singular.......demands whatsoever of ____ JOHN
LANE and SARAH his WIFE in law or equity or otherwise....... or intends so to be
_ with the aforesaid THOMAS PRICE his heirs........whatsoever and the said JOHN
LANE and SARAH his WIFE for themselves and their heirs covenant, promise.....
and agree to and with the said THOMAS PRICE and his heirs and assigns...........

Be it remembered that on the 13th day of April AD 1849 __ me A. DAVIS Esq. one
of the Justices of the Peace for the said County came the above named John Lane

Sarah being of full age......

NOTES on the above DEED:
1. shows relationship of father Revolutionary Soldier John Lane to his son John
Lane, Jr.; the land was willed to the son, John Lane, Jr. of Bedford Co., Pa.
2. proves that John Lane Jr. was still living in Bedford Co., Pa. in 1849 when
my ancestor John Lane (Sr.) had already died in 1844 in Washington Co., Pa.
3. selling to Thomas Price makes sense because the Rev. Soldier John Lane Sr.
was married to Catherine Price and Thomas Price was probably related;
4. shows that John Lane Jr. of Bedford Co., Pa was married to Sarah (Davis, her
maiden name is proven through other means).
5. bears name Alexander Davis; Sarah, John's wife, was the sister of Alexander
Davis
6. adjoins land of David Lane, brother of the real John Lane Jr. of Bedford Co.,
Pa, both sons of the Revolutionary Soldier John Lane Sr.

ATTENTION INTERNET READERS
Over the years, I have been contacted by many people who were trying to
research based on Emma McKinley Nease's information. ALL of us have
concluded the DAR Application is wrong.
Because of limited funds, I was never able to share all the documents concerning
my research on this problem. Between 1984 and 1990, I collected
documents (for all 8 John Lane men) from: Frederick Co., MD, Washington Co., PA,
Bedford Co., PA, Carroll Co., OH, and Ripley Co., IN. Overall, I think
I've done a superb job of putting together copies of original records that
support my case, but, as in all large projects, something may have been
overlooked. I am hopeful that others may have found additional records
that can further support my claims.
I hope within the next 3 to 6 months to scan ALL the documents I have concerning
this research.
