The petition of T. J. Henry respectfully represents:
That your petitioner was duly appointed guardian of Arthur C. and Grace A. McCafferty, minerchildren of Emma McCafferty deceased, on August 1st 1898 by the Orphans Court of Armstrong County, Pa.
That Lewis Doverspike, grandfather of said minor children died on the 7th day of 1898, having first made his last will and testement, duly probated and recorded in Will Book, Vol. 5 page 550, which will is made part of this petiton, and provides inter alia as follows:
"And at her Amelia's death, or when she was re marries the residue or remainder of my property, real, personal or mixed, shall be devided equally between my heirs, including Samuel, then living, share and share alike"
That Amelia, wife of said Lewis Doverspike, died prior to his death, that at the death of said Lewis Doverspike he was seized of certain real estate, situated in Mahoning Township and South Bethlehem Borough, Armstrong County, Pa., consisting of about 30 acres of land.
The said Lewis Doverspike left to survive him the following children, namely:
Rachael inter married with John A. Baker
Caroline inter married with John R. Keener
Irwin Doverspike
H. L. Doverspike
S. M. Doverspike and grandchildren, issue of a deceased daughter, Emma McCafferty, as follows:
Nelson
Mary E.
Charles A.
Lewis I.
Aruthur C.
and
Grace A. McCafferty.
The first four mentioned being at the present time over the age of 21 years, and the others are represented by your petitioner as guardian.
That all the parties in interest, who are minors, have executed a deed to I D Doverspike for the consideration of $1800.00 for those certain lots piece or tract of land situated in the Borough of South Bethlehem, County of Armstrong and State of Pennsylvania, bounder and described as follows:
