To Leicester Babcock and Phelix [Phelix is written in different pen and handwriting] Carrico administrators of the estate of Lydia Musick deceased.

You are hereby notified that depositions of witnesses to be used in evidence in the above estate in the above court will be taken at residence of B. F. [?] Wood & [?]  A. Fuqua store in the county of McCracken in the state of Kentucky on this day of May 13th & 14th & 15th A. D. 1872 between the hours of 8 o’clock in the forenoon and 6 o’clock in the afternoon of said day and the taking of said depositions if not completed in that day will be continued from day to day at the same place and between the same hours until completed: the object and purpose of said depositions being to prove and establish the heirship at law of Pious Carrico, Elizabeth Carrico and James W. Grimes in and to said estate and also to prove the right and interest of said Pious Carrico in and to said estate by purchase from James W. Grimes:  said depositions taken on part

Depositions of witnesses produced sworn and examined on the 13 day of May 1872 between the hours of 8 o’clock in the forenoon and 6 o’clock in the afternoon of the day and date afore written at the residence of B. F. Wood and A. Fuqua store in the County of McCracken and McCracken [sic] State of Kentucky, in a certain estate now pending in the Probate Court of St. Louis County, state of Missouri Known as the estate of Lydia Music deceased of which estate Leicester Babcock and Phelix Carrico are Administrators Said depositions being at the instance [sic] and on the part of Pious Carrico Elizabeth Carrico and James W. Grimes for the purpose of proving and establishing their claims as heirs at law to said estate and also to prove the right of said Pious Carrico in and to said estate by purchase from James W. Grimes.

Ellen Wood taken on the day date and between the hours before written, to be read as evidence on behalf of Petitioners in the style and action as aforesaid Deponent being of lawful age and first duly sworn deposed and says

My age is between 70 & 75 years.  Residence McCracken Co., KY.

Ans:
I am [blank] years old reside in McCracken County Kentucky

Please state whether you know Pious Carico Elizabeth Carico and James W. Grimes.

Ans:
I do.

Qs:
Please state what you know of their parents & whose children they are & where their parents resided at the time of their birth & where were their parents married & what was their mother’s maiden name.

Ans:
I knew their parents.  Pious Carico’s parents lived in St. Louis County, MO at the time of his birth.  His father’s name was Daniel Carico.  His mother’s name was Mary Carico.
Elizabeth Carico J. W. Grimes were grandchildren of Daniel and Mary Carico.

Elizabeth Carico is the daughter of Frank

Carico and Manerva Carico Frank Carico was the son of Daniel and Mary Carico.

James W. Grimes is the son of O. D. Grimes and Mary A. Grimes formerly Carico.

Frank Carico and Mary A. Grimes were born in St. Louis County, MO and both died in Kentucky.

Daniel Carrico married Mary Grimes my sister in St. Louis County, Missouri in 1819 or 1820.

Qs:
Were you ever acquainted with Lydia Music?  If yes, what relation was she to Daniel Carico.

Ans:
I have seen her and always understood her to be Daniel Carico’s sister.

Qs:
How many children had Daniel Carico and his wife Mary Carico and what were their names where were they born & how many & who of them are dead and where did they dye?

Ans:
There was eight children
-Pious
-John
-Mary A.
-Susan
-William
-Frank
-Reuben &
-James.

-Pious Carico was born in St. Louis Co., MO Dec 22 1821.
-John Carico was born St. Louis Co., MO Apr 22nd 1823 & died in McCracken Co., KY in the spring of 1847.  Left no heir.
-Mary A. Carico (afterwards M. A. Grimes & mother of J. W. Grimes) was born in St. Louis Co., MO Jan 23rd 1826.  Died in McCracken Co., KY 24th Mar 1853.  Left a son J. W. Grimes.

-Susan Carico born in McCracken Co., KY Feb 20 1828.  Died in McCracken Co., KY.  She was never married.
-William Carico was born in St. Louis Co., MO Sept 23rd 1830 & died in St. Louis Co., MO without an heir.
-Frank Carico was born in St. Louis Co., MO Jan 21st 1834.  Died in Ballard Co., KY.  Left one child, Elizabeth Carico.
-Reuben Carico was born in St. Louis Co., MO 1836 & still lives in St. Louis Co., MO.
-James Carico was born in McCracken Co., KY Jan 16th 1838.  Died at Little Rock, ARK without an heir.

Please state the relation between the above named Caricos, Mrs. Lydia Music dec. & by which of the parents that relationship exists.

Ans:
They are her nieces and nephews by their father’s side.

Please state whether you know Pius Carico, Elizabeth Carico & J.W. Grimes.  If yes how long have you known them and who was their parents.

Ans:
I have known all three of them from their infancy.
-Pius Carico is the son of Daniel & Mary Carico who died in McCracken Co., KY.
-Elizabeth Carico is the daughter of Frank Carico & granddaughter of Daniel & Mary Carico.
-J. W. Grimes is the son of Mary A. Grimes (formerly Carico) & grandson of Daniel & Mary Carico.

Qs:
Please state all you know about the marriage of Daniel Carico & Mary Grimes & their children & what relation they were to Lydia Music.

Ans:
I knew Daniel Carico & his wife Mary Carico (formerly Grimes) from a child as long as they lived.
They had eight children as enumerated in Mrs. Ellen Wood’s deposition which I have fully read and fully endorse.

Qs:
Please state whether you know Pius Carico to be son of Daniel & Mary Carico and nephew of Lydia Music & what is the relation between Elizabeth Carico and J.W. Grimes & Lydia Music.

Ans:
-Pius Carico is the son of Daniel & Mary

Qs:
State what relation you are to J.W. Grimes and to Daniel & Mary Carico & what you know about the conveyance by J.W. Grimes of his interest in the estate of Lydia Music deceased to Pius Carico.

Ans:
I am father of J.W. Grimes & son in law of Daniel & Mary Carico having married their daughter Mary A. Carico and J.W. Grimes is the offspring of that marriage.  I have heard my son J. W. Grimes say he had sold and conveyed to Pius Carico his interest in Lydia Music’s estate.

Qs:
From the best information you have what is the relation between Lydia Music decd. and Pius Carico, J. W. Grimes & Elizabeth Carico & how that relation exist.

Ans:
My information is that Pius Carico is nephew to Lyddia Music Deceased by his father side she being his father sister.

J. W. Grimes & Elizabeth Carico are the grandchildren of Daniel Carico therefore grandnephew and grandniece of Lyddia Music.

Qs:
How did you obtain that information.

Ans:
By being nearly allied with the family having married Daniel Carico daughter.

The deposition of Pius Carico taken May the 14th 1872 at the store of A. Fuqua, Woodville, McCracken Co., KY in the action as set forth in the caption he being first sworn.

Question by Petitioner:
State your age & place of residence.

Ans:
My age is 50 years.  Residence is Ballard County, Kentucky.

Qs:
State if you are acquainted with Elizabeth Carico and how long you have know her and who was her father and whether he is living or dead.

Ans:
I have known her ever since birth which is about twelve years.  She is the daughter of Frank Carico who is dead.  He died in Ballard County, Kentucky on the 1st day of October 1861.

Qs:
Whose son was Frank Carico and what was the relationship between Frank Carico & Lyddia Music Decd.

Ans:
He was the son of Daniel Carico who was a brother of Lyddia Music (formerly Carico).  Frank Carico was Lyddia Music nephew.

Qs:
How many brothers & sister had Frank Carico and what were their names.  How many of them are living and how many of them who are dead and where did they die.

Ans:
He had seven brother & sisters [1 half brother is also named] that is his brother were
-Pius Carico,
-John Carico,
-William Carico,
-Reuben Carico,

-Mary A. Grimes who died in McCracken County, Kentucky.
-Susan Carico who died in McCracken County, Kentucky.
-William Carico died in St. Louis County, Missouri.
-James Carico died in Little [Rock], Arkansas.
-Walter Carico the half brother died in St. Louis County, Missouri.

Qs:
Who and how many of them left children.

Ans:
My half brother Walter Carico left children.  I do not know how many.
Mary A. Grimes left one son J.W. Grimes who lives in McCracken County, Kentucky.

Qs:
Who was the father and mother of Pius Carico, John Carico, William Carico, Reuben Carico, James

Ans:
Daniel Carico & Mary Carico all except Walter Carico who was son of my father Daniel Carico by a first marriage.

Qs:
Were you personally acquainted with Lyddia Music Decd. If yes how long have you known her.

Ans:
I was acquainted with her from my childhood as long as she lived, having lived in her family some two years of my life.

Qs:
Do you know from your long and intimate acquaintance with Lyddia Music that she always acknowledged Frank Carico & Mary A. Grimes to be her nephew and niece?

Ans:
I do.  Mary A. Grimes having live with her a good portion of her life before she married O.D. Grimes.

Qs:
Do you know Elizabeth Carico to be the daughter of Frank Carico born

I do.  I was at Frank Carico marriage.

What relation is J.W. Grimes and Elizabeth Carico to Lyddia Music Decd.

Ans: 
J. W. Grimes is grandnephew and Elizabeth Carico is grandniece of Lydia Music Decd.

Ans:
Age - 22 years.  Residence - McCracken Co., KY.

Qs:
Please state what what [sic] relationship you hold towards Lyddia Music decd and what were your parents names?

Ans:
I have heard my father O.D. Grimes speak of her as my great aunt.  My father name is O.D. Grimes.  My [mother’s] name was Mary A. Grimes.

Qs:
Is your mother Mary Grimes dead or living?  If dead how long since she died.

Ans:
She is dead.  She has been dead 20 years.

Qs:
What relationship have you always been taught existed between Pius, John Carico, William Carico, Reuben Carico, James Carico, Mary A. Grimes, & Susan Carico & yourself?

Ans:
That they were my uncles and Aunt except Mary A. Grimes who was my mother.

How many of them dead.  Who of them did you ever know personally.

Ans:
I know Uncle Pius & uncle Reuben who are living.  I also knew uncle Frank, uncle William & uncle James who are dead.

Qs:
Do you know Elizabeth Carico?  If yes whose daughter is she.

Ans:
I know her.  She is Uncle Frank Caricoe’s daughter.  I have frequently seen him nurse and fondle with her while a baby up to the time of his death.

Qs:
Did you sell & convey to Pius Carico your interest in and to Lyddia Music Estate.

Ans:
I did sell & convey to Pius Carico my interest to a certain piece or parcel of land lying & being on Cold Water Creek, St. Ferdinand Township, St. Louis County, Missouri known as Lydia Music land as per deed executed by me to Pius Carico and I suppose of record in the clerk office of St. Louis Co., MO.

Has Pius Carico paid you a valuable consideration for said interest in said land as set forth in the deed.

Ans:
He has.

Grimes was taken before me in McCracken County at the times and places above named and were red [sic] to them by me and subscribed by them in my presence in the action as mentioned in the caption the said Ellen Wood, O.D. Grimes, Pius Carico and J. W. Grimes being first sworn by me that the answers they should give in the action should be the truth the whole truth and nothing but the truth and their statement by me reduced to writing in their presence the plaintiff alone being present.

This day personally appeared before me, the Clerk of the Probate Court for the County of St. Louis, the undersigned Leicester Babcock and Phelix Carrico who being by me duly sworn, upon their oaths say that to the best of their knowledge there are the following named heirs of Lydia Musick deceased, now in being; to-wit:

1.  Walter Carrico and
2.  Melina Fugate both of St. Louis County,
      brother and sister of said deceased,

3.  Lydia wife of Phelix Carrico of Warren Co., MO., only child of Felix Carrico who was a brother of said deceased,

the unknown heirs of
4.  Daniel Carrico,
5.  James Q. Carrico and
6.  Benjamin Carrico
late brothers of said deceased and
 
7.  the unknown heirs of Asa Carrico & Elizabeth Carrico
late half brother & half sister of said deceased

and that to the best of their knowledge, the said deceased died without a will, so far as they know and believe; and that they will make perfect inventory of, and faithfully administer all the estate of the deceased and pay the debts as far as the assets will extend, and the law direct, and account for and pay all assets which shall come to their possession or knowledge.

Whereas I am informed that Lydia Musick late of the County of St. Louis has departed this life intestate, and that you as her brother are entitled to administer on his[sic] estate;W you are therefore at the request of Pious Carrico hereby cited to be and appear before the Probate Court of the County of St. Louis aforesaid (or the Clerk thereof, in vacation) at the Court House in said County, and take out letters of administration on the estate of said deceased, on or before the First Monday of May next, or in default thereof letters will be granted to the person next entitled thereto or to such other person as said Court or Clerk shall consider most suitable.

[Lydia’s estate was divided into sevenths.  Benjamin had four descendants who were Isaiah, Asa, Sarah Ann Carrico Musick, and probably Malinda Carrico Hoessolbreath/Hazelbud.
-Isaiah’s children were Lydia Anderson, Milton N. Carico, Mary Ellen Stout. 
-Asa’s child was George W. Carrico.
-Sarah Ann Musick was alive. 
-We have a death date of bef the 1860 Census for Malinda but we do have a daughter Sarah E. Hoessolbreath/Hazelbud for her but don’t know if she was alive.  If so that would make up the four descendants of Benjamin.]

Personally appeared before me a Justice of the Peace in and for the County of Bond, State of Illinois James Bettenton and Nancy Reeves who being duly sworn according to law that Isaiah Carico the husband of Nancy Reeves and the father of Lydia Anderson, Milton N. Carico and Mary Ellen Stout, was the son of Benjamin Carrico, the brother of Lydia Musick deceased.

Reference being hereby made to deposition of Nancy Reeves made Janry 13th 1874.

Personally appeared before me a Justice of the Peace in and for the County of Bond and State of Illinois, Nancy Reeves who being duly sworn according to law deposes and says that she was acquainted with Lydia Music, late of the county of St. Louis state of Missouri.  That said Lydia Music was a aunt to one Isaiah Carico, that she (affiant) was married to said Isaiah Carico [brother written & crossed out &, we think, “nephew” is written in] of said Lydia Music on or about the sixth day of October 1841 that her husband the said Isaiah Carico died on or about the (”unknown” written in) day of (”unknown” written in) 1860 leaving affiant as his widow and the following named children as fruits of said marriage viz
-Sarah Ann Carico,
-Lydia Carico,
-Milton Carico,
-Mary Ellen Carico. 

That the said Sarah Ann Carico has since died leaving no children that the said Lydia Carico has since intermarried with one James Anderson who is still living and that the said Ellen Carico has since intermarried with one Martin Stout who has since died leaving her a widow.  Affiant therefore further states on her oath that the said Lydia Anderson, Milton N. Carico and Mary Ellen Stout are the only living children and heirs at law of said Isaiah Carico decd who was a [brother written & crossed out &, we think, “nephew” is written in] and heir at law of said Lydia Music decd and that affiant is widow of said Isaiah Carrico decd.
