John Carrico
vs
Theresa Carrico, Thomas Luckett and Juliet his wife, Violet Carrico,
Jane Carrico, James Carrico, Benedict J. Carrico and Augustus Carrico,
heirs and representatives of Gustavus Carrico.
The bill in this case states, that Gustavus Carrico in his lifetime,
purchased of Zephanah Waters certain tracts or parts of tracts or
parcels of land lying in Charles County, State of Maryland, commonly
called and known by the names of "Waters chance," Waters Risk, Bristol
and Jacob's birthright, supposed to contain one hundred and ten acres,
and paid therefor the sum of four hundred dollars. that at the time of
said purchase, the said Gustavus Carrico executed a bond to said Waters
conditioned to reconvey said Land to said Waters, upon his returning
the money aforesaid with interest. The said Gusavus Carrico hath since
died intestate, leaving the following legal heirs and representatives,
to wit: a
sister, Theresa Carrico,
entitled to one half of his estate, your orator,
John Carrico, Juliet Carrico, who
intermarried with a certain Thomas Luckett, Violet Carrico, Jane
Carrico, James Carrico, Benedict J Carrico, and Augustus Carrico,
children of Wilfred Carrico, who was a brother of said deceased,
and each entitled to one-seventh of one-half of said estate. That your
Orator hath obtained from the Orphan's Court of Charles county, letters
of adminisration upon the personal estate of said Gustavus Carrico,
deceased. That said Waters hath also since died intestate, upon whose
estate his widow, Catherine Waters, hath, who is willing and prepared
to refund the money before mentioned, upon having the lands reconveyed
in conformity with the bond of said Gustavus Carrico. the object of
this bill is to enable the administrator of said Carrico to demand and
receive said money, by obtaining a re-conveyance of the lands aforesaid
to the representatives of said Waters, and as it is represented that
all the heirs of said Gustavus Carrico reside out of the State of
Maryland, it is therefore ordered by the Judges of Charles County
Court, sitting as a Court of Equity, that the Complainant cause a copy
of this order to be published in the National Intelligencer once a week
for six successive weeks, warning the absent heirs aforesaid, of the
filing and object of this bill, and that they be and appear in this
Court either in person or by solicitor, on the third Monday in March
next, to shew cause, if any they have, why a decree should not pass as
prayed.
