At the Request of James Carricoe of Charles County the following Deed was Recorded this 24th
day of March Anno Domini 1741 ~~
This Indenture made the ninth day of March in the year of our Lord God one Thousand
Seven hundred and forty two Between Thomas Pulton of Charles County in the Province of
Maryland Gentleman of the one part and James Carricoe Planter of the other part Witnefseth
that the aforesaid Thomas Pulton for divers good causes and considerations him thereunto
moving hath demise Let and doth let, and by these Presents doth demise Let and to farm , Let
unto the said James Carricoe his heirs or afsigns a Parcel of a tract of Land Lying Situate
and being in Charles Cunty runing from a marked Chestnut standing on the Easternmost

side of a Small Branch runing thence north ten degrees, Easterly one hundred and forty
Perches till it Intersects the line of Mr. Parnhams Land and thence with the Line
north fifty degrees Easterly one hundred and ten Perches to the line of Mr. John Pigeons
and thence with the Line south ten degrees westerly one Hundred and forty Perches and
thence South fifty degrees Westerly Westerly one hundred and ten perches to the first marked
Chestnut Containing by Estimation one Hundred and four acres of Land being more
or Lefs to have and To hold the said Parcell of Land to the said James Carrico, Catherine
Carrico his wife and Sarah Carricoe his Daughter commencing from the day of the date
hereof yielding and paying therefore yearly unto the said Thomas Pulton his succefsors
or afsigns on the nativity of our Lord and Savior, being the five and twentieth day of
December, seven hundred pounds of Good Merchantable leaf Tobacco in Cask upon the said
Parcel of Land, yearly as as aforesaid, in in case the yearly rent or any Part of Parcel thereof
Shall remain unpaid thirty days after the prefixt day being the five and twentieth day
of December as aforesaid that then it shall and may be Lawfull for the said Thomas
Pulton his Succefsors of afsigns to distrain on any of the goods of said James Carricoe his
heirs or afsigns to the value unpaid or at his or their pleasure unto all and singular the
before demises Premifses to renter and the same to have again and retain as his or their
former Estate and the said James Carricoe and his heirs and all other occupiers thereof
out and from the same utterly to expel remove and put out any thing compris'd to the
Contrary, Nothwithstanding the said James Carrico doth for himself his heirs or afsigns
Hereby Covenant and agree to and with the said Thos Pulton his succefsors or afsigns by
these presents in manner and form following that is to say the said James Carricoe
his heirs or afsigns shall not without the Special Leave of License of the said Thomas
Pulton or his Succfsors Cut fall or dispose or Sell any sort of timber ot timber trees standing
growing or Lying upon the said Land, otherwise than the proper use of the said
Plantation, That is to say for necefsary fencing and inclosure or for building and
necefsary Reparations or casking for Tobacco or Cyder or other drink made on the said Land
Provided that it shall and may be Lawfull at any time during the term Limited in
this Indenture for the said Thomas Pulton or his Sucefsors to cut fall and Carry
away any timber trees for his their own Particular use in building or as his or their
occasion shall require, furthermore the said James Carrico, his heirs or afsigns shall
leave all Houses and edifeces on the Land, erected and built, and all the fencing
whatsoever in or upon the said Land, erected and built, and all the fencing
whatsoever in or upon the said Lands in good repair and tendable at the expiration
of the said term or time of the three lives above mentioned and in case the said Lands
herein mentioned be at the time exposed again to be lett out as Coppy held Land that
the said James Carricoe his heirs and afsigns shall have the refusal thereof, Provided
he or they be Contented to pay so much the same as any person or persons shall be
willing to give or allow, furthermore the said James Carricoe shall not let any part

or Parcel of the said Lands to any preson or persons without the Consent and good liking of
of the said Thomas Pulton or his Sucefsors and in case likewise the James Carricoe his
Heirs or afsigns shall be Contented to desert or sell the the Land with what interest
he or they shall have therein before the expiration of the said time and Term of three
Lives above mentioned, then the said Thomas Pulton, or his succefsors shall have the
Refusal thereof he or they allowing so much as any other person or persons shall be
willing to give for the same. Lastly the said James Carricoe his heirs or afsigns shall
give his and their attendance and due homage to the said Thomas Pulton of
any disturbance or demur should arise upon the said Lands or with the Tennants
upon the said Lands. In Witnes whereof both Parties to this Indenture have
Interchangeably set their Hands and Seals the day and year first above written.
