It was Commanded this sheriff that he should take Peter Carricoe late of Charles County Planter if &c
And him safe keep so that he should have his body before the Justices of the Lord Proprietary of his next
County Court to be holden at Charles Town on the Second Tuesday November next to answer  unto
the Lord Proprietary and George Keith Junior who as well for the Said Lord Propry as for himself Prosecutes
of a plea that he Render unto them the sum of five Thousand Pounds of tobacco which he ow unto and may unjustly
Detain from the said Lord Proprietary and the said Georg Kieth Junior who as well for the Said Lord
Proprietary as for himself in this Behalf Prosecutes &c and that he should have then and there this Writt &c
And now here at this day to wit the Second Tuesday in November afsd The? here the afsd Returns to the Court her(e)
the Writt afsd Thus Endorsed viz

At which day to wit the Second Tuesday in November afsd Comes here as well the said George Keith Junior

George Scott his attorney an the said Peter Carricoe by Jeremiah Chase his attorney Com before to the Court here
that he will not any further Prosecute for the Said George against the said Peter in the plea afsd it is therefore considered by
the Court here that the said george take nothing by his Writt afsd but that he and his Pledges of Prosecuting be in mercy
&c and the said Peter go thereof without say &c It is Likewise Considered that the said Peter do Recover
against the said George One hundred and Seventy Eight Pounds of Tobacco for his Cost and Charges by him about
his defense in this Part sustained to the same Peter at his request by the Court here adjudged according to the form force
and Effect of the Statute in those Cases late made and Provided and that the same Peter have thereof Execution

Judgment on S?? Return of Referees ? Defendants
Charles County to wit George Kieth Senior late of Charles County Planter was Attached to Answer unto
Peter Carrico and Margaret his wife of a plea wherefore with force and arms and Soforth he made an assault
upon the said Margaret at Charles County afsd and her the said Margaret then and there did beat wound
Evally Treat so the he Life was Greatly Despared of and other Enormitees to her the said Margarett then
and there to the great damage of Him the said Peter and Margarett and against the Peace and Soforth
Peter Carrico and Margarett and Margarett his wife by Jeremiah Chase their attorney Complains that the
said George the               day of                  in the year of our Lord one Thousand Seven Hundred & fifty
with force and arms an Assault her the said Margarett at Charles County afsd did make and her
the said Margaret did then and there beat wound and abuse so that of her life it was Dispared
and other oughes (?) of the same Margarett then and there Committed against the Peace of the lord Propryitary
That now is; and to the damage of them the said Peter and Margarett fifty Pounds Paper Currency
and therefore suit is Brought & Soforth                                  J Chase for the Plaintiff ???????
and the said George Keeth by J Hall his Attorney Comes and Defends the force and Injury or harm
and Prays  hence thereof to Impart here untill the next Court to be Holden at Charles Town the
Second Tuesday in August next and he Hath it and the same day is Given to the said Peter & Margaret
here &c at which day to wit the second Tuesday in August afsd Comes as well the said Peter and Margarett
as the said George by his Attorney and the said George by his said Attorney Prays Further Leave (?)
thereof to Imparte here untill the next County Court to be Holden at Charles Town on the Second Tuesday
in November and he Hath it and the same day is given to the Same Peter and Margarett here

at which day to wit the Second Tuesday in November Comes as well the said Peter and Margarett by
their Attorney afsd as the said George by his Attorney afsd and the said George by his Said Attorney
Prays Further License thereof to Impart here untill the next County Court to be Holden at Charles
Town on the Second Tuesday in March next and he Hath it and the same day is Given to the said
Peter and Margarett here &c at which day to with the Second Tuesday in March afsd Comes as well the
said Peter and Margarett by their Attorney afsd as the said George by his Attorney afsd and the said
George by his said Attorney Prays Further License thereof to Impart here untill the next County
Court to be holden at Charles Town on the Second Tuesday in June next and he Hath it and the same
Day is given to the said Peter & Margarett her &c and now here at this day to with the Second
Tuesday in June afsd Comes here the Parties afsd by their attorneys afsd and do agree and Submitt the
whole matter in Variance to be Determined by Allen Davis and Thomas Smoot Referees by the Court
hereof the Consent of the Partyes afsd Especially appointed whereupon it is said to the said Allan Davies &
Thomas Smoot that they have the whole matter in Veriance between the Parties afsd before the Court
Here &c and afterwards to wit the same Second Tuesday in June afsd Comes the said Allan Davies & Thos
Smoot Referees afsd  who Returns to the Court the Following award Viz Charles County &c  ?????????
do agree that the Plantiff Pay the Defendant his Costs Witness our hands this 26 Day of January.

Whereupon the same George Deith Senior by his Attorney afsd Prays Judgment of and upon the Return of
the Referees afsd in form afsd found for him to be given therefore it is Considered by the Court here that
the Peter and Margarett take nothing for his Writt afsd but that he and his Pledges of Prosecuting
be in mercy &c and the said George go hereof without day &c. It is further Considered by the
Court here that the said George do Recover against the said Peter and Margarett Costs Two Hundred
and Thirteen Pounds of tobacco for his Costs and Charges by him about his defence in his Behalf
Sustained to the same george by his Assent by the Court here adjudged According to the form force and
Effect of the Statute in those Cases late made and Provided and that the said george have thereof
Execution.

here ?? at which day to wit the Second Tuesday in June, afsd Comes as well the said George & the lord
Proprietary by their Attorney afsd as the said Peter by his Attorney and the said Peter by his Attorney Prays
Further License thereof to Impart him untill the next County Court to be Holden at Charles Town
the second Tuesday in August next and he hath it and the same day is given to the same George
and the lord Proprietary here &c and now here at this day the Second Tuesday in August afsd Came
here as well the said George and the lord Proprietary by their Attorney afsd as the said Peter in his Proper
Person afsd Comes here the Parties afsd do agree and Submitt the whole matter in Variance to be
Determined by Allan Davis & Thomas Smoot Referees by the Court hereof the Consent of the Parties afsd
Especially appointed Whereupon it is said to the said Allan Davis & Thomas Smoot that they the
whole matter in Variance between the Parties before the Court here ?? and afterwards to wit the
Same Second Tuesday afsd Comes the said allan Davvis and Thomas Smoot Referees afsd who
Returns to the Court here the Following award Viz: Charles county for we the subscribers do agree
that the Plaintiff Pay the Defendant his Costs Witness our Hands this 26 Day of January 1756
